I was on ketamine twice while in the hospital via iv for pain management. It helped calm me significantly. But after the second time I had a seizure and could no longer take it.
If it was a known side effect as early as 2005, even if the doctor didn’t tell you, it would have been in the printed literature the pharmacist gives you when you pick up your meds. Or available in some other way.
The way the law works (at least, in the US), is that if a reasonable person would have known or could have known or found out, then you are held to that reasonable person standard, and the doctor would not be responsible for that side effect, and you wouldn’t have a case.
It wasn’t printed, I read it. I think only after the FDA announced it the FDA decided to include it in medication paper.
Well, I don’t know all the circumstances, but @Charles_Foster recalls that the information was out there prior to your beginning to take it. Therefore, under US law (again, can’t speak for Canada), you would not have a case against your doctor or the pharmaceutical company.

Cases like this are not black letter law.
You bring a case that says you didn’t know, and a lawyer presents an argument about why you should have known. Then the jury deliberates – was it reasonable that a person would know this, under your exact circumstance?

Anyways, I am not thinking about it anymore. They will likely say its my sz. I don’t have the mental capacity to go to court etc I am sure nothing will come out of it. Money won’t cure me, I was receiving more than disability from work insurance and from covid funds up until last month. Now I am living off my parents money. I need to apply for disability soon.
You don’t know what they would say without talking to someone about your case.
My parents dont give me money…sometimes i feel like its abusive. Like my dad doesnt want me to succeed. He told me not to take four classes and do all this “scholarship” stuff and just let him pay for one class so I dont fail.

Yes, they were very clear to me the risk of accepting the drug. It is dangerous. I knew the risks and tried it. But the hospital was very clear that it was dangerous, so even though I had a seizure, I could not sue for the damage it caused to my body.
Like I said in your other thread, it sounds like you might be misinterpreting your father’s intentions. It sounds like he is trying to help you.
If ketamine worked for you then sarcosine should work. And it’s much safer and no risk of psychosis
Sarcosine is an agonist at the glutamate receptor and Ketamine is an antagonist.
There end goal is the same to restore dysfunction of the glutamate receptor.
