my brother in law and my father are both trying to get ssdi and so far they have been trying but denied. my dad has tried for ten years and just gave up. my brother in law is in the captial right now trying to get approved for ssdi and i was told by my dad’s lawyer that it takes 90 days to make a decision but my mother in law seems convinced they can grant it right at the hearing.emphasized text
It’s very helpful to have an attorney that specializes in SSDI. Also, contact your Congressperson.
It differs… One of my friends moms was given ssdi at her first apeals hearing… But diff places do it differently…
Yeah, have they consulted with an attorney? I’m sure you guys have thought of this. There are attorneys who specialize in getting people their rightful benefits.
I got awarded SSDi and SSI back in 1982. My first attempt was denied so we hired a lawyer who did all the paperwork and everything else necessary. Then we got a hearing in a small room with a judge. It was just me, my parents, my lawyer and the judge in the room. My lawyer (who was actually an old family friend from our church) told me I would not have to talk much. He also told me not to lie but he said that we could shade the truth a little in our favor.
The hearing went smoothly, I got approved and I paid the lawyer half of a retroactive check I got. But that was a long time ago. I think they still give people lump sums of retroactive benefits from the date you first applied. My diseased friend (R.I.P.) applied and wasn’t awarded SSI until 5 years later. He got a lump sum of $25,000 which he could spend it on anything he wanted.
Wow, 25,000, really. That was saved up over 5 yrs?
I got approved on my first try, less than three months and no attorney. But I also am a veteran rated 100% disabled by the VA. So I got expedited processing.
I was working up until the time I applied though so I didn’t get any back pay and had to wait five months for benefits so I am glad I didn’t need a lawyer.
If your medical records are solid and show disability you will get approved but you have to be totally disabled. SSDI doesn’t pay for partial disability.
Sorry, that was a ballpark date. I remember for sure that he first applied in 1978. I remember he got $25,000.
I am not sure of the date that he was finally approved. I met him in 1983 or 1984. I think that he got that money before I knew him but I’m not positive. I think SSDI was only giving about $700.00 per month back then while right now, I personally get more than that. But yeah, the guy bought two cars, he bought the best, biggest tool chest he could find and filled it up with tools (he did his own car repairs.) He bought a bunch of radio controlled model airplanes and last, but not least he also hired more than one escort at $150.00 a shot.
I got SSI in a few months. Got it on my first try, so that’s good I guess.
I had some help from some kind people in order to get it.
i got it right away without a fight. but my dad, brother, and brother in law have all had lawyers to try and get theirs. my dad was denied multiple times and just gave up. my brother was denied for over 10 years and was finally given SSI. but i worry he can lose it by not complying with doctors and taking meds. anyway my brother in law is trying to get ssdi and my mother in law said the truly sick ones get it straight away from the hearing on. but i remember when my mom had to fight for my brother’s he had to wait 90 days after his hearing.
My dad tried to get it due to his chronic pain, but the judge said my dad was faking it. Needless to say, he was really pissed.
