Not sure anyone will remember but basically I got approved partially in 2021, he put my disability start date much later, so we appealed and went to court again with the same judge and he ended up saying nvm you’re not disabled at all and threw out all evidence. So we appealed that decision and I just now got the denial letter. I have no idea if or when I’ll loose SSDI. We appealed that decision and next is a 3rd court hearing.
Im so sorry, that must be so heartbreaking. I hope the court hearing goes better than the appeal.
Do you think it was targeted, the decision? Because of your educational background or because of your dyed hair or something like that? What are the grounds for him Dismissing?
It was a phone interview but I do have a bachelors degree, even though I struggled super hard the entire time. He just said the testomonies I had were all not reliable suddenly when they were before, said my autism doesn’t effect my work even tho my assessment clearly states it does, a few other things. My lawyer said it was a typical denial where you Magnify any inconsistencies you make at all, even over a ten year case where things can shift.
I’m sorry this is happening to you. Sounds like a financial nightmare.
Yeah, he’s gotten into his head that you’re not disabled and so he thinks he can do it or he’s some sort of right-wing fascist? Can I say right wing on the site?
Who doesn’t believe in SSI?
Idk I think if it was personal like that he would have denied me the first time
@Moon I’m so sorry. That’s awful and frustrating to be denied. I am on SSDI and was approved on the first try. I can’t imagine the stress you must have right now!! I get stressed and more symptoms when I get a review for my SSDI. It is definitely tough. I hope your appeal goes well.
So theyre saying because of work history and school history theyre denying you?
Kinda but also just discrediting my limitations
If you have a degree, it’s very likely the court will deny your disability benefits
They approved me once so
@swordiebrom , I have a bachelor’s degree and I was approved for SSDI.
@Moon , if I were you, I’d take the next step and contact my congressman. Write them a letter about possible discrimination. Does this judge know your gender fluidity (not sure of the correct lingo for you - sorry). Discrimination is a real possibility in your case.
Yes the judge asked me if my trans identity was disabling at all, I said no. And he referred to me by my chosen name so he knows
Ok. Yup. Contact your congressman!
I did! Thank you for the suggestion
Good. Best of luck!
